Authorizes owner of tract within corporate boundaries of City of Damascus to withdraw tract from city in certain circumstances. Requires filing of request for withdrawal with mayor and governing body of city. Requires public hearing on questions of whether requirements for withdrawal are met and whether withdrawal will cause undue hardship on continued operation of city, as determined at time request for withdrawal is filed. Requires governing body to consider and make determinations on questions and adopt ordinance or resolution approving or rejecting withdrawal. Provides that determination by governing body, or withdrawal of tract due to failure of governing body to make timely determination, may be appealed to circuit court. Prohibits city from annexing withdrawn tract for 10 years after withdrawal.
Declares emergency, effective on passage.
